Regrettably, we were denied our Contempt Motion in court yesterday, as we argued that the Temporary Injunction from the Judge’s ruling on Aug. 4th, and it’s protocols and expert testimony should be upheld. The Governor’s attorney argued that the matter of re-opening process had been shifted to Arizona Department of Health and that Mountainside would likely need to pursue legal remedies against ADHS rather than the Governor.
At this point, we share the same complete frustration as our Members, who simply want to re-open Mountainside Fitness and return to improving their physical and mental health during this difficult time. As our legal remedies have not been successful, we will pursue the process provided by the ADHS, and re-opening soon will be inevitable.
